I was just looking at the tide charts for Novermber...the 24-26th have some decent high tides (20+ ft. above mean low water), occurring between 1-3am with a new moon.....would be interesting to see what "could" happen to the wreck then! I wonder if it will float????
Walked around the wreck, up close this afternoon. I could have walked right inside. There is no disassembly going on. There is nothing apparent leaking out of the hulk. Approaching down wind there was a whiff of publilc toilet on the breeze. There are three braces along the seaward side as if to prevent the thing from rolling over more on its side. Someone has recently gone around the hull and filled some openings with foam insulating stuff, the yellow stuff that expands. The rudders appear intact, not obviously bent or disconnected. The propellors are both completely ruined, bent as if they ran across rocks but they are brass and are a tempting target for the copper thieves I'm sure. The hulk is surrounded with some material apparently to contain any leakage. There are several ropes attached, but very small, as is the mini anchor. The small ropes might be useful in hauling a larger line to attach but not much else. All in all looks like little has been done.
Not taking any bets on this one let me do calculation on how long it will take for the metals to break down being that close to the salt water. I am suprised the props are still there that is a few hundred bucks on scrap value.
Whats the over/under on how long this thing sits on the beach? Any takers? We can parlay it with a side bet on how quick the Malecon gets finished.

They may sink it, but I doubt it. Its still somebodies personal property and besides they would probably have to do an environmental impact study to sink it, now when we want even to clear a lot or build near the ocean, we have to pull a permit for an impact study. Its probably headed to the boat yard.
They will send it to the boat yard weld on some patches slapp on some new paint and have it ready for the spring breakers. Impact study would take to long and the cleaning of the boat would cost to much money.

When I was down there I met a guy who said he was on the boat when it happened. He said one engine was running but the capt. could not steer the boat. Sounds like the controls between the wheel and the rudders failed. Maybe cable or hydraulic ?
They can turn the diesels on that boat into bilge pumps... That's a shame it was taking on so much water... that is such a nice boat... I hope Mike can laminate that hull and get it seaworthy again...

Trash cans from The Reef all the way down to Playa del Sol is a big step to help clean up the beach a little. Not too long ago I saw for the first time in my life a MEXICAN picking up trash in CHOLLA BAY. I believe I've read just about every thread or article available. And thank all of you for your genuine concern on the passing of my mother. The overall picture I get from the comments is of unsafe and negligent behavior by the owner of the vessel. I deeply urge you good people of Rocky Point to help stand against the influences of people who promote your area under a guise of false pretenses. This will ultimately be your result if he's not made accountable for his actions. My mom lived there for 41 years as much as she did her U. S. residence. We will all miss her,dearly. If the ship was so close to shore, why would there not be any rescue units deployed? The crew obviously had no clue how to handle the emergency situation. There was no logical explanation for the captain to leave dock at any time. The storm warnings were issued long before they set sail...... obviously they were ignored....Why? $$$$ Pesos will never replace the life that was lost....Why was the 80 year woman not one of the first passengers removed from the boat by the Navy???? Women & infants first????? Let alone the elder....

First off, I'm deeply sorry for your loss. I lost my father unexpectedly 3 years ago this week, and it still effects me. Regarding your question about the elderly, someone had earlier mentioned that this was an older-age club of some sorts going on this particular night, and that most of the passengers were older as well. Can anyone else confirm or refute this?
And yes, what a terrible tragedy motivated by greed, even after the recent incident in San Filepe when the ship's captain was told not to set sail and several lives were lost.

There is one other issue that is unclear to me. It was stated at one point that the Captain of the ship never appeared to sail that evening. So, who was the Captain? Was he self-appointed? Or was there a quick stand-in Captain available for the owner to appoint in charge of his ship? Or did the owner,himself, assume the captain's position? Don't know the laws in Mexico, but in the states, you have to be a licensed "captain" to take "passengers for hire"... and the requirement is pretty stringent...I read somewhere that the owner is American...does Mexico even license non-mexicans as a "captain"???

He is the owner and indeed American, and he took it upon himself to captain the boat that evening, when the true captain didn't or couldn't show up.. I have been told that he has done this numerous times in the past.
Once again I would like to express the "need" for justice against this boat owner. The man willfully and knowingly lead 44 passengers into a horrifying nightmare and left one,very special lady, without her life. And rumor has it he"s out and about,already. That"s also the reason it will continue to happen again. Until someone or someplace stops him and makes him accountable for his negligence, he will continue on his path of mayhem.

I guess before you do that, you know need to find out what the pd "report" says. What are "their facts". It seems to me there's lots of speculation on this thread, but we're not really certain of what the official report from PPPD is.
If you went on a quest for justice, I would surely back you up and sign a petition or anything that may be needed. I certainly don't want Sherman or any other "Captain" to put my family or anyone else in danger. It would help teach a lesson to others if this man was held accountable.
There is nothing good about this situation. Yes there is a need for justice. If there were criminal laws broken the Mexican DA will have to move on it. Independent of that, as in the US, one can file a civil suite here in Mexico. If the owner is a US citizen or has assets in the US you might be able to go after those assets in the US as well. I have a Mexican friend here who did that and got a judgement but as usual could find no assets to take. As always, the legal route is long and twisted not to mention expensive. In the US , there would be an insurance company involved, wonder if there is one in this situation.
I do not think the Puerto Penasco Police are the ones to approach. Approaching the US consulate is probably a good idea. Yes there is a lot of speculation here.
We US citizens who have no direct involvement cannot do too much without creating a potential hazard for ourselves. EVen signing a petition could cause you as a non-citizen a problem.

Nothing in Tucson either, it is quite odd. Shows you the residual effect of buying extra media time, i.e. the Sonoran billboards, newspaper and TV ads. You won't ever see any Jim Click scandal, for example, that guy pretty much keeps the ad departments in business, which often trump the editorial staff.
Well, they have been working on the boat. It was originally tilted down side toward the sea. It now sits fairly level. A large number of sand bags are now hanging off the shore side along with a long heavy pipe dangling sand bags. Could see sand bags inside on the deck on that side also. The seaward side has a series of wood braces and 'legs' welded to the botttom, out at an angle to brace the thing. The brass props are gone.

FYI, Sherman (Fiesta Cruiser) has been spotted working on the triple decker, Carnival Tour Boat. I had heard he bought it and apparently its true. He must not have too many problems over the beaching of the Fiesta, cause he is back at it. The Carnival is the boat that got stuck in forward gear and plowed into 3 or 4 shrimp boats.
I'd like to make one more statement regarding this travesty. Setting aside all the rumors and misunderstandings, the facts remain. The man set sail in a closed harbor. He assumed the Captain"s position on an evening cruise ship. Immediately,became beached on a sandbar and beat-up the prop or props on the sand and rocks in an attempt to save face,instead of unloading passengers. When he broke free,he had no steering control and was at the mercy of the rough sea and prevailing winds. He did not have the safety equipment he brags about in his "best boat in Rocky Point" ad. The passengers were terrified and somehow my mother lost her life. Those are pretty much the indisputable facts. Was there even an investigation? And now you tell me the man at the helm is footloose and fancy free! I'm sorry but that does not rest well on me in the U.S. or any other country for that matter!

Just heard from a friend who was told he needed to move his boat, that they will be moving it at 11:30pm tonight... also heard other reports that it is going to be cut up for scrap and not allowed to go back into service....

just got home... I went down to see if they would tow the fiesta away... as of 1:00am the tide was high and the boat was afloat but no one there to tow it away... there were 2 or 3 people on board the fiesta with flashlights, they got there about 10:45pm...
several vehicles stopped on top of the hill and shined their headlights down on the fiesta and then drove off... a couple of people walked down because they also thought it was going to be moved, one of them, an elderly american gentleman named Jim who has been in Rocky Point for about a week stayed and we talked until 1:00am, at that time it was getting pretty chilly, so we decided to head out...
If you ask me, I would say that it is a total disgrace to even think that pathetic bucket of rust might go back into the business of endangering the lives of innocent people. It's just a shame that the local authorities don't show any backbone and enforce the law. This will do more to hinder tourist from going to this area and ironically it's in an effort to protect a tourist promoter who could care less about tourists. I was there Wednesday and Thursday nights (Turs. and Fri. mornings)... each night the tides were high enough to float that boat (I said boat because rust bucket didn't rhyme) I actually saw it bobbing up and down from bow to stern due to the waves, it was completely off the bottom...
My amigo who owns a bigger boat in port that needs to be moved every night they say that they are moving the fiesta is getting tired of wasting his time and diesel moving his boat and they do nothing with this scow... makes you wonder who's running this show..?
Here I go again. You see a situation here where the boat won't be towed because of rough waters. Why is that a factor to a controlling agent, who will brave the rough waters with 44 passengers aboard? Even with the harbor closed, this person showed no fear. Only lost one life. He must have been in the right or he would, surely, have been reprimanded by authorities. No doubt, a legendary sailor of our own times!!

An article, I read last week said repairs were being made where the boat sat, so maybe they are going to float it under it's own power. We all read the captain of the port said it was sea worthy, wouldn't it in his opinion still be, if its just a rudder cable, that snapped when he hit the sand bar. Out of town shrimp boats always hit the sandbar, when they pull into port, the entire northwest entry into the port is a sand bar at low tide. But when anybody else hits it they are smart enough to sit and wait for high tide and float off of the sand bar, usually with no damage.
Bill...I got up close to it last week...if he means within about a quarter mile of shore...yeah, it may be seaworthy...I wouldn't get on that heap any further!
Russ Been there Done that, This was the first time I had ever been on the Cruiser. This thing is in need of a good sinking. Scared me just walking on the deck The floor between the decks was completely eaten away.
Regardless of what they do with the boat, the fact that it was involved in claiming an innocent life should never be forgotten. I walked down and looked at the ship several times last week. I can only imagine the sheer terror some must have felt the night it went to land. It is such a shame that someone had to lose their life.
Rosie and Russ mentioned on Rocky Point Ramblings this weekend that another one of the passengers, who had previously suffered from a stroke, had yet another stroke shortly after the Fiesta Cruiser wreck. She didn't come right out and blame it on that night but I'm sure it didn't help. Does anyone else have some information on this gentleman? He was able to function on his own prior to this last stroke, but is now being taken care of in Phoenix. He's not able to get back to Penasco until he can find someone who is qualified to be his permanent care-giver. She may have already started a separate thread on this and I missed it, but if you know someone who would be able to help, I'm sure you could just contact Rosie on here to get more information.

This picture shows the Fiesta Cruiser when she was called the Starlet ll working in the waters of Honolulu Hawaii. Shown in the background is Honolulu with the natives in their dugouts approaching the tour boats.
The Fiesta Cruiser was built in New York then was sailed past the Florida Keys through the Panama Canal to Honolulu Hawaii. Two other fishermen and I made the trip from Hawaii to Puerto Peñasco. The winds were manageable varying 15-55 miles an hour.
I saw that thing sitting on the shore in the ship yard and wondered what it was all about. Sort of the glass bottom boat I guess. Well run, might be a good addition. Poorly run another disaster waiting to happen.
I guess I didn't look hard enough... I was just talking with one of my buddies from la bajada (the ramp) and he told me that Sherman does have another boat here... it's named Los Cabos and from what others have been saying it looks like a converted shrimp boat... I'll try to get photos tomorrow...
